Current Need

McKesson’s well-regarded General Counsel Organization is seeking a healthcare transactional lawyer to support the McKesson Health Systems (MHS) customer segment (which includes hospitals, health systems, integrated delivery networks, long term care, alternate site providers and specialty pharmacies) for both US Pharma distribution and its subsidiary, McKesson Plasma and Biologics LLC (“MPB”). will also support PACT, a McKesson group purchasing organization serving MPB and McKesson’s wider US Pharma customers.

McKesson’s U.S. Pharmaceutical Distribution business (US Pharma) supplies pharmaceuticals and other healthcare-related services and technology products to a wide range of retail and institutional pharmacy customers. US Pharma’s nation-wide network of distribution centers supplies medication to 1/3 of all health care providers in the United States, and MPB distributes plasma and specialty products to acute care, specialty pharmacy and alternate site customers.

Position Description

  • Oversees day-to-day legal support including draftingand negotiating distribution, consignment and rebate program contracts; review RFPsand marketing materials for legal compliance

  • Oversees day-to-day legal support for PACTincluding drafting and negotiation of manufacturer pricing agreements and memberagreements, and advising on the structure of, and contracting for, value addedservices;

  • Key contact for special legal issues such ascustomer terminations, contract interpretation and analysis;

  • Serves as legal advisor to MHS, MPB, and PACT accountmanagers and other stakeholders on a wide array of topics relating to thecustomer segment needs, including legal risk mitigation, customer relationshipmanagement and retention, and strategic initiatives and service offerings;

  • Frequent interactions with other internalstakeholders across functional groups.

Minimum Requirements

6 years of healthcare and/or corporate law experience

Critical Skills

  • Excellent commercial contract drafting andnegotiation skills; experience personally structuring, drafting and negotiatingcomplex transactional agreements

  • High comfort providing health care regulatoryadvice (anti-kickback law, FCA, privacy, 340B, government contracting,antitrust), preference for experience in the hospital or specialty pharmacyspace and/or negotiating commercial contracts with health care providers

  • Outstanding verbal and written communicationskills

  • Excellent interpersonal skills with anability to provide sound, clear legal advice

  • Ability to work closely with, facilitateinteractions within, and influence cross-functional stakeholders (includingrepresentatives from other areas of the law department, regulatory andcompliance professionals, sales professionals and operations managers).

  • Notable business acumen dealing with riskmanagement and organizational savvy

  • Must be a team player who can develop strongworking relationships and work collaboratively with internal clients and othermembers of the legal senior team.Ability to lead by example including a willingness to “roll up yoursleeves” and undertake day-to-day legal work.

  • Large law firm experience combined with in-houseexperience, preferred
