Merck Senior Associate, U.S. Formalities in Rahway, New Jersey

Position Description:

The Office of General Counsel is seeking a Senior Associate, U.S. Formalities to provide operational support to the Patent organization. Primary responsibilities are to prepare and execute all official U.S. and foreign formal documents and to accurately track and cite relevant background art or information to the United States Patent and Trademark Office (USPTO). Position is located in Rahway, NJ.

Job responsibilities include but are not limited to:

  • Independently prepare and obtain inventor signatures on Worldwide Assignment, U.S. Declaration and PCT Power of Attorney

  • Timely and accurately track and manage cited patent references (U.S. patent literature, foreign patent literature, and non-patent literature (NPL)) in departmental document management system

  • Obtain and update references as needed from identified resources, including translations of foreign references

  • Prepare information disclosure statement (IDS) (PTO/SB/08A and 08B) for filing with the USPTO in coordination with responsible attorney

  • Add Supplemental Disclosure Statement action to docketing system if necessary

  • Monitor docket report for all US formality due dates to ensure deadlines are timely met

Education Minimum Requirement:

  • High School diploma or equivalent required

  • Associate degree or Paralegal certificate preferred

Required Experience and Skills:

  • Two (2) years patent experience in a corporate or law firm setting

  • Familiarity with USPTO rules, law and procedures

  • Experience working with USPTO’s Electronic Filing System (EFS-Web) and electronic forms

  • Ability to utilize IP Software with the demonstrated ability to learn new technology, processes and procedures effectively and with confidence.

  • Advanced proficiency with MS Office Suite (Outlook, Word, Excel)

  • Extraordinary accuracy and attention to detail in analysis and communications

  • Strong organizational and time management skills, able to prioritize workflow, manage and meet competing deadlines

  • Strong communication skills, both oral and written

  • Strong interpersonal skills, collaborates well with others, skilled at interacting with all levels of personnel with professionalism

  • Resilient and change-agile, able to work in a fast-paced environment with a high volume of work

  • Able to handle confidential information sensitively and discreetly

Preferred Experience and Skills:

  • Two (2) years U.S. patent formality experience in a corporate or law firm setting

  • Strong understanding of USPTO formality requirements including 37 C.F.R. Rules and MPEP rules

  • Specific experience with Thomson IP Manager and First-to-File

  • Notary Public Commission
