This role has been established as part of the Shell Group's Global Litigation Department for handling the Group´s disputes (litigation, arbitration and regulatory) in the Latin America & Caribbean region in a proactive, timely, cost effective and professional manner in furtherance of business objectives and protection of shareholder interests. Main accountabilities are:
identifying legal issues relevant to matters handled and acting with the appropriate urgency;
handling a broad range of cases in a variety of areas;
identifying all potential issues related to the matters handled and relating them to the business objectives;
identifying options for achieving business objectives within applicable legal and cost restraints;
fully understanding the Shell Business Principles and Code of Conduct and challenging business decision-making process in respect of potential breaches;
updating the business on significant developments in the matters handled;
recommending legal contingencies and provision to litigation matters;
reporting significant litigation risks within the Group Control framework;
maintaining matters in the group-wide management database;
interfacing with lawyers in other departments in Shell Legal Services regarding litigation risks impacting their areas of responsibility;
assisting more senior lawyers in the group in handling high exposure matters;
working closely to paralegals in auditing and budget tasks;
working with HR in labor and employment matters.
The successful candidate will be responsible for:
case assessment process;
management of outside counsel;
recommendation of provisions and disclosures;
settlement or resolution recommendations;
compliance with Shell policies and procedures relating to settlement authorities;
management of reputational issues;
reporting of lessons learned;
negotiating and managing the budget for each matter including the budget for external litigation counsel and all other expenses related to the matter;
building appropriate fee arrangements;
coordination with appropriate internal and external stakeholders.
This position demands a lawyer with experience in managing a large docket of small to medium exposure litigation disputes either as an outside counsel or in-house counsel.
The successful candidate must:
have outstanding academic credentials;
have a Brazilian bar registration (OAB);
have knowledge of dispute resolution processes;
have excellent interpersonal and communication skills;
be able to work effectively with Shell businesses and internal and external stakeholders;
have excellent skills as an advocate and as a legal counselor to the businesses;
have excellent skills managing outside legal and other third party resources;
have clear understanding of business organizations and governance structures;
be fluent in written and spoken English and Portuguese.
Good knowledge of labor and employment law, including related litigation, is a plus.
